JUSTICE BIRENDRA KUMAR ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The petitioner is mother-in-law. Husband is already in custody. There is allegation of demand of dowry and torture for the same as a result whereof allegation is that the victim was done to death in her matrimonial house.

Submission is that the ligature mark was found on the dead body of the deceased, which shows unnatural death of the deceased. However, there is no corroboration of demand of dowry nor any eyewitness supported that murder was committed.

No.5189 of 2017 (3) dt.23-03-2017 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Nalanda at Biharsharif/Successor Court in connection with Sohsarai Police Station Case No.133 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
