2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 399,402,414 of the Indian Penal Code, sections 25(1-B)(a), 26 and 35 of the Arms Act and sections 8/20 (b) (ii) (B) of the NDPS Act.
3. One of the co-accused who was apprehended along with other accused on the spot with live cartridges, motorcycle and 2.550 kilograms Ganja, has taken name of the petitioner as one who fled away on arrival of police party.
4. Learned counsel appearing for the petitioner submits that petitioner's name has come in this case on the confessional statement of co-accused and no incriminating article has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge cum Special Judge, Muzaffarpur in Baruraj Police Station Case No. 108 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
