This is an application for anticipatory bail for the offence punishable under sections 147, 148, 149, 341, 232, 324, 325, 307, 504, 427, 295 (A), 353, 436, 186 and 188 of the I.P.C.

Allegedly the persons named in the F.I.R. and ten unknown forming an unlawful assembly armed with deadly weapons and fire arm looted the shop of the local shop-keepers and also set ablaze some vehicles. The name of the petitioner transpired later on. It is submitted that the petitioner is a constable and he was not present in the mob. Petitioner has been granted pre-arrest bail in Chainpur P.S. Case No. 62 of 2013 wherein he was named and in this case the case of the petitioner is on better footing. The petitioner is in duty in Governor house, Lucknow and he is at the verge of retirement. Kaimur at Bhabua in Chainpur P.S. Case No. 61 of 2013, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
