The petitioner has preferred this application for grant of regular bail in a case registered under section 379 of the Indian Penal Code to which sections 401, 411 and 413 of the Indian Penal Code were added subsequently.

As per the prosecution case, the accused persons on a motorcycle took away the bag of the informant which contained mobile phone etc.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. In course of investigation Jai Kumar and Rupesh Kumar were arrested who confessed to their crime and stated that they had handed over

Contrary to the allegation, no incriminating article has been recovered from the petitioner's possession who is in custody since 1.6.2021 and chargesheet has been submitted in the case without putting him on T.I. Parade. The petitioner has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent and having remained in custody for over 8 months, the Court directs the petitioner to be enlarged on bail in connection with K. Hat P.S. Case no. 220 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea.
