In this case, the petitioner is seeking regular bail in connection with Mahua P.S. Case No. 474 of 2019, registered for the offences punishable under Sections 395, 397 of the IPC. As per allegation, some unknown miscreants committed dacoity in the house of the informant. They also assaulted the informant and made him injured. The learned counsel for the petitioner has submitted that nothing was recovered from possession of the petitioner. He was not put on T.I.P. and co-accused Raja @ Prince @ Sarfaraj in whose confessional statement, the name of the petitioner has figured, has been granted bail by a coordinate Bench of this

Patna High Court CR. MISC. No.37737 of 2023(2) dt.03-07-2023 2/2 Court in Cr. Misc. No. 29147 of 2020. Some other co-accused persons on the similar footing have also been granted bail by the coordinate Benches of this Court.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 474 of 2019, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to be cancelled.
