Petitioner seeks bail in Raghunathpur P.S. Case No.148 of 2019 registered under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act.

The informant got information about keeping of liquor in the house of Manu Yadav and on such, a raid was conducted. The informant found two motorcycles parked on the darwaja of Manu Yadav. The liquor was kept in the bag tied with the motorcycle. Altogether 682 litres of country made liquor was recovered. The informant further alleged that Manu Yadav used to deal in liquor along with Ragho Yadav (petitioner), Guddu Yadav, Dashrath Yadav and Sri Niwas Yadav.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.34378 of 2020(3) dt.29-01-2021 2/2 nothing has been recovered from possession of the petitioner. Of course, the petitioner has got criminal antecedent and he is accused in two other criminal cases registered under different sections of the Excise Act but the petitioner is in jail since 29.08.2020. The petitioner has already remained in jail for five months.

Taking into consideration the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner is in jail for five months, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Siwan in connection with Raghunathpur P.S. Case No.148 of 2019.
