Admittedly the name of the petitioner does not figure in the Assembly voter-list. Although she applied on 14.1.2016 but the fact remains that her name has not been entered in the final voter-list published on 25.1.2016. The petitioner took no steps thereafter and came before this Court on 2.3.2016 filing the writ petition when notification in terms of section 124 of the Bihar Panchayat Raj Act, 2006 (hereinafter referred to as 'the Act') has already been issued by the State in its Panchayati Raj

It is stated by Mr. S.B.K. Manglam, learned counsel appearing for the petitioner that the name of the petitioner has since appeared in the Assembly voter-list on 2.2.2016. Mr. Amit Shrivastava, learned counsel appearing for the Commission informs that some communication is likely to be issued by the Commission to all District Election Officers for including all those voters whose names figure in the Assembly voter-list by issuing a supplementary voter-list for the Panchayat Election. In view of the statement made at the Bar by Mr. Srivastava, this writ petition is disposed of with a direction to the District Election Officer (Panchayat), Sitamarhi to consider the case of the petitioner for inclusion of her name in the supplementary voter-list stated to be published in the light of the advisory issued by the State Election Commission.
