In this case, the petitioner is seeking regular bail in connection with Obra P.S. Case No. 140 of 2020, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The Police received a secret information that the petitioner along with other accused persons engaged in sale of liquor. On the basis of said information, the Police party reached the place and on seeing the police party they tried to flee away, but Police apprehended two persons but, one person managed to escape. On search, about 267.6 litres of illicit liquor has been recovered from a pick-up van.

Learned counsel for the petitioner submits that the

No.36376 of 2020(2) dt.05-02-2021 2/2 petitioner has been arrested on 18.06.2020 and co-accused Mukresh Vishwakarma has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 30.09.2020 passed in Criminal Miscellaneous No. 24368 of 2020. Considering the aforesaid facts, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-VII-cum- Special Judge (Excise), Aurangabad, in connection with Obra P.S. Case No.140 of 2020, subject to the condition that (i) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of bail and (iii) the petitioner would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.
