This is an application for anticipatory bail for the offence punishable under sections 147, 148, 149, 341, 323, 324, 325 and 385 of the I.P.C.
Allegation is of demanding extortion for making construction and due to non fulfillment assaulting the informant and others.
Submission is that accusation of assault is omnibus and general and the injury has been found to be simple and even assuming the accusation no offence under section 307 and 384 I.P.C. is made out. The petitioner has got no criminal antecedent. Similarly situated co-accused Govind Yadav and Shankar Yadav have been allowed pre-arrest bail vide order dated 20.03.2014 in
Patna High Court Cr.Misc. No.29765 of 2014 (2) dt.15-01-2015 2/2 Cr. Misc. No. 1903 of 2014 by another Bench of this Court and further Jayram Yadav, Naresh Yadav and Pitambar Yadav have also been allowed pre-arrest bail by this Court on 09.01.2015 in Cr. Misc. No. 29602 of 2014.
Considering the aforesaid facts, let the petitioner in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Nawada in Kawakol P.S. Case No. 72 of 2013, subject to the conditions as laid down in section 438 (2) of the Cr.P.c. (Jitendra Mohan Sharma, J) Abhay/- U T
