The petitioner apprehends his arrest in a case registered for the offence punishable under Section 498(A) of the Indian Penal Code.

The complainant- wife alleges that the petitioner along with other in-laws subjected her to all sorts of physical and mental torture and her husband is not ready to keep her. Learned counsel for the petitioner submits that the petitioner is ready to keep his wife and his wife is not willing to live with the petitioner. The wife appeared before the learned Sessions Judge and she reluctantly expressed her view not to live with the petitioner.

Having considered the facts of the case and nature of allegation and further that the wife appeared before the learned

No.4363 of 2015 (2) dt.02-02-2015 2/2 Sessions Judge and she herself disclosed that she was not ready to live with her husband without any reason, let the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand0 with two sureties of the like amount each to the satisfaction of learned Subdivisional Judicial Magistrate, Darbhanga, in Darbhanga C.R.Case No. 1510 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
