JUSTICE PURNENDU SINGH ORAL ORDER 31-07-2023 Heard Mr. Prabhakar Singh, learned counsel appearing on behalf of the petitioner and Mr. Bindhyachal Rai, learned counsel for the Accountant General, Bihar.

Learned counsel appearing on behalf of the petitioner informs this Court that the petitioner is the legal representative and he is entitled to receive family pension which was not paid to his mother on account of the fact that the father of the petitioner had died in harness on 24.04.2019 while he was posted as Sub-Inspector, CID, Patna, and the mother of the petitioner had died on 28.02.2020 but she was not given family pension in spite of the fact that the P.P.O. was issued in her

Patna High Court CWJC No.14701 of 2021(5) dt.31-07-2023 2/3 favour and statement to that effect has been made in paragraph no. 10 of the writ petition.

3. The petitioner is directed to file a detailed representation with respect to his entitlement on account of different heads of pensionary benefits relating to his father. He must file a copy of Succession Certificate along with 'No Objection' from the legal representative of the deceased employee for getting the family pension approved to his mother which was not paid during her lifetime.

4. The Inspector General of Police (Welfare), Government of Bihar, Patna- respondent no. 5, is directed to ensure to make payment of all the retiral dues to which the deceased employee was entitled to the petitioner in the manner as provided by law within a period of six weeks.

5. The petitioner, if so advised, may file a detailed representation giving the details of the dues to which the petitioner is entitled for.

6. The representation of the petitioner is directed to be disposed of and all the payments including medical reimbursement, if any, be made to the petitioner within the aforesaid period of six weeks.

7. It goes without saying that any dues to which the

8. Accordingly, the present writ petition is disposed of.
