No one appears on behalf of opposite party No. 2 though notice has already been served upon her sister-in-law with whom, she resides.
The petitioner apprehends his arrest in connection with Complaint Case No. 103-C of 2012 registered under Sections-498-A, 494 of the Indian Penal Code and Section-4 of Dowry Prohibition Act.
Petitioner happens to be husband of the opposite party No. 2 and admittedly, the marriage of the petitioner was solemnized with opposite party No. 2 on 06-
Patna High Court Cr.Misc. No.31070 of 2014 (5) dt.31-07-2015 2/2 06-1996. Furthermore, it is admitted case of the complainant that she remained at her matrimonial home only for about two months and after that, she came to her parental home where she still resides.
It appears that the complainant only wants share of her son in the property of the petitioner. In my view, the complainant may take other recourse for redressal of her above-said grievance. Accordingly, it is ordered that the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, shall be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Complaint Case No. 103-C of 2012 to the satisfaction of Chief Judicial Magistrate, Khagaria.
