The petitioner apprehends his arrest in a case registered for the offence under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act. It is submitted on behalf of petitioner that specific accusation of firing is against co-accused Om Mehta. So far as this petitioner is concerned, though there is allegation of firing against him to the deceased, but same did not hit the deceased or anybody else. Petitioner has got clean antecedent. Learned counsel for the informant vehemently opposed the prayer for anticipatory bail and submitted that petitioner is named in the F.I.R. and he also fired upon the deceased.

No.37777 of 2022(2) dt.22-11-2022 2/2 Considering the aforesaid facts and circumstances as well as clean antecedent of petitioner, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Medni Chowk P.S. Case No. 40 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
