The petitioners seek pre-arrest bail in connection with Alauli P.S. Case No. 20 of 2016 registered under Sections 341, 323, 504, 467, 468, 471 & 420 read with 34 of the Indian Penal Code.
It is contended that the petitioner No. 1 had purchased the land in question on 03.10.2013 through sale deed and the petitioner No. 2 had also purchased the land in question on 24.07.2014 through another sale deed after due payment of consideration amount to the vendors and the aforesaid land was
Patna High Court Cr.Misc. No.12082 of 2016 (2) dt.17-03-2016 2 / 2 mutated in their names and they are paying the rent to the State of Bihar.
Regard being had to the nature of allegation made in the FIR and the argument advanced by the learned counsel for the petitioners, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 20 of 2016 subject to the conditions as laid down under Section 438(2) Cr. P.C.
