====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-09-2024 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the complainant.

2. The petitioner apprehends his arrest in connection with Complaint Case No. 1265-C of 2022 registered under Sections 420, 406 and 120-B of the Indian Penal Code.

3. It is alleged that after taking consideration money of Rs. 10 lakh from the complainant, petitioner did not register the land in favour of complainant and refused to return the consideration money.

4. Learned counsel appearing on behalf of the petitioner submits that dispute involved in this complaint case is purely of civil nature and colour of criminal offence has been given only with a view to settle the civil dispute between the parties.

5. Learned counsels for the State and the complainant opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I, Danapur, Patna in connection with Complaint Case No. 1265-C of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
