This is an application for anticipatory bail for the offence punishable under sections 304 (B), 328/34 of the I.P.C. Petitioner No. 2 Sadhu Roy has been arrested and as such permission has been sought to withdraw his bail application which is permitted and against him the bail application stands withdrawn. Allegedly the daughter of the informant was married two years ago with one Anil Roy and he along with other co-accused including the petitioners used to torture her for not fulfilling the demand of Rs. 50,000/- and ultimately she was poisoned to death.
Submission is that petitioner no.1 Tara Devi is mother-in-law. She is living separately from the husband and daughter of the informant since long and as such she deserves sympathetic consideration, to which the learned A.P.P. opposes.
Patna High Court Cr.Misc. No.29607 of 2014 (2) dt.13-01-2015 As submitted, petitioner no.1 is living separately and there is no specific allegation against her rather the allegations are omnibus and general in nature and as such petitioner no.1 Tara Devi, in case of her arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Purnia in Meerganj P.S. Case No. 85 of 2013, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
