The petitioner is apprehending his arrest in connection with Parsa P.S. Case No. 187 of 2015 for the offences instituted under Sections 120(B) and 366(A)/34 of the IPC. The prosecution story, in brief, is that on the date and time of occurrence, the daughter of the informant, namely, Karmshila Kumari, aged about 17 years, had gone to take residential certificate but she did not return. During search of his daughter, the informant had acknowledged that the petitioner and others have kidnapped the daughter of the informant with their criminal conspiracy to marry her with the petitioner Arjun Sah and the main allegation of kidnapping to his daughter is against the

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner has falsely been implicated in the present case. The victim girl has been examined under Section 164 Cr. P.C. where she has denied the allegation made in the FIR and has admitted that she has performed marriage on her own will with this petitioner. The Medical Board examined the victim girl and has stated that she is above 19 years.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Parsa P.S. Case No. 187/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran at Chapra, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
