JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-12-2020 Heard Mr. Arjun Prasad, learned counsel for the petitioner and Mr. J.N. Thakur, learned APP for the State. The petitioner seeks bail in connection with Hisua (Hasua) P.S. Case No. 131 of 2020, dated 21.04.2020, instituted for the offences under Sections 341, 323, 457, 376, 511, 379 and 34 of the Indian Penal Code. He is said to be in custody since 12.06.2020. The allegation in the F.I.R. is that the petitioner and one Raju Chauhan forced open the door of the house of the prosecutrix and tried to outrage her modesty. Learned counsel for the petitioner has submitted that co-accused/Raju Chauhan is the brother-in-law of the prosecutrix and they are at litigating terms because of a dispute over drainage. It has further been submitted that since the petitioner is a friend of aforesaid Raju Chauhan, he too has been implicated in this case.

Regard being had to the afore-stated facts and the nature of accusation as well as the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Hisua (Hasua) P.S. Case No. 131 of 2020.
