Initially the case was registered under Section 147, 148, 149, 452, 341, 323, 307. 324, 379, 380 of the Indian Penal Code wherein on account of death of Ram Murti Rai, Section 302 of the Indian Penal Code was added.

Informant Shambhu Rai has alleged that on account of his protest over illegal activity of co-accused Dhyani Rai and Karu Ray, they along with their family members chased having variously arms and further entered inside the house and began to assault. On account of which he along with his father Ramdayal Rai, uncle Ram Murti Rai and brother Devnandan Rai have sustained injury. They have also taken away chain as well as

Patna High Court Cr.Misc. No.12380 of 2016 (2) dt.31-03-2016 2/2 articles appertaining to Rs. 40,000/-.

Both the petitioners are ladies. From the order impugned it is evident that case diary was available while passing the order wherefrom also, no specific allegations levelled against these petitioners is visualizing.

That being so petitioners 1) Lal Muni Devi and 2) Laidun Devi @ Naidu Devi @ Naidun Devi, independently is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M, IV, Samastipur in connection with Mohiuddinagar P.S. Case No. 197 of 2015 in event of their arrest or surrender within six weeks from the date of receipt/production of the order in terms of condition so enumerated under Section 438(2) of the Cr.P.C.
