06-10-2021 Heard learned counsel for the parties.

Earlier, the bail petition of petitioner was rejected, vide order dated 01.03.2021 passed in Cr.Misc. No. 40839 of 2020.

On last occasion, vide order dated 25.08.2021, a report with regard to stage of the trial was called for, which has been received and kept at flag 'R'. From perusal of the same, it appears that charge has already been framed against the accused persons on 28.06.2021 and at present, the case is fixed for prosecution evidence.

It is submitted on behalf of petitioner that petitioner, who is husband of the deceased, has renewed the prayer for bail on the ground that earlier, the bail petition of petitioner was rejected without considering the facts stated in the case diary. In

Patna High Court CR. MISC. No.47709 of 2021(3) dt.06-10-2021 2/2 paragraph no. 27, 28 and 31 of the case diary, the informant has stated that his daughter has not been killed, rather she committed suicide because she was not allowed to come to her parental house on the Shradh of her grand-father. Petitioner is in custody since 05.06.2020.

However, learned A.P.P. for the State opposed the bail petition and submitted that earlier the bail petition of petitioner was rejected by this Court considering the materials available on record. Petitioner is husband of the deceased and there is specific allegation of demand of dowry and torture against him. Taking into consideration the nature of accusation and the stage of the trial, the bail petition of petitioner is rejected. However, the trial court is directed to expedite the trial.
