The petitioner apprehends his arrest in Complaint Case No. 184C of 2013, registered for the offences punishable under Sections 376, 354, 380 and 379 of the Indian Penal Code. The complainant alleged that the petitioner entered into her house and took her inside the room and made attempt to outrage her modesty.

Learned counsel for the petitioner submits that all the allegations are false. The petitioner is neighbour of the complainant and on account of some petty dispute this case has been filed.

Patna High Court Cr.Misc. No.4576 of 2015 (2) dt.03-02-2015 On the facts, it appears that the complainant made allegation against the petitioner that the petitioner took her inside the room and made an attempt to outrage the modesty, hence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

However, the petitioner, if so advised, may surrender before the court below within four weeks and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
