The petitioner apprehends his arrest in Complaint Case No. 180/14 registered under Sections 354, 406, 420, 467, 468, 471/34 of the Indian Penal Code.
The complainant Anjum Aara alleged that she wanted to purchase a piece of land for construction of a house. Amzad Khan (the petitioner), who happens to be her distant relative, introduced Rakesh Kumar and Imran Khan. Rakesh Kumar executed a deed of sale in favour of Mahatab Alam, the husband of the complainant, with regard to Khata No. 381, Plot No. 4911. The petitioner identified the execution of the said sale deed.
Patna High Court Cr.Misc. No.4922 of 2015 (2) dt.04-02-2015 2/2 Learned counsel for the petitioner submits that since the petitioner happens to be the relative of the complainant, he put his signature as identifier of the sale deed. He did not either receive the consideration money nor did he induce the complainant to purchase the land.
Considering the fact that the petitioner is only the identifier of the sale deed, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Complaint Case No. 180/14, corresponding to Tr. No. 7100/14, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
