The petitioners, 14 in number, are apprehending their arrest in Kurtha P.S. Case No. 48/2014 registered under Section 307 and other sections of the Indian Penal Code. The informant alleged that while he was sitting near a temple, the accused persons demanded money for taking wine but, on refusal, the accused persons assaulted him and others. Learned counsel for the petitioners submits that all the allegations are false and concocted. From the side of the
Patna High Court Cr.Misc. No.4924 of 2015 (2) dt.04-02-2015 2/2 petitioners, Kurtha P.S. Case No. 47/14 was registered against the informant and others. Due to land dispute, the occurrence took place as the informant has fraudulently purchased a piece of land. The informant and other injured got simple injuries as would appear from Annexure 3 series. From the side of the petitioners also, four persons were injured.
It appears that there is a case and counter-case. The informant and others got simple injuries. The occurrence took place on account of land dispute.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Shashi Kant Rai, Judicial Magistrate 1st Class, Jehanabad in Kurtha P.S. Case No. 48/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
