The petitioner apprehends his arrest in Nadi P.S. Case No. 242 of 2018, registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. Allegation is of recovery of 36 litres of Indian made foreign liquour from a boat.

It is submitted on behalf of the petitioner that name of this petitioner figured in this case on the basis of confessional statement of co-accused. Nothing has been recovered from the possession of this petitioner. Petitioner has got no criminal antecedent. Similarly situated co-accused has been granted bail by a Coordinate Bench of this court vide order dated 06.03.2019 passed in Cr. Misc. No. 13346 of 2019.

No.35595 of 2019(3) dt.07-08-2019 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna in connection with Nadi P.S. Case No. 242 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
