JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 427, 504, 506, 435, 448 and 34 of the Indian Penal Code and Section 3 (I), (X) (XI) SC/ST Act.

Prosecution case is that the informant was working at home with her brother. In the meantime, the petitioner no. 1, namely, Tasrif Ansari came there and started abusing and blamed that she is allowing his daughter to go a wrong way. Thereafter, the petitioner no. 1 came along with his wife and children and assaulted the informant and her brother and abused them by caste name and set ablaze the motorcycle of the informant's brother.

Patna High Court Cr.Misc. No.12532 of 2016 (2) dt.17-03-2016 2/2 It is submitted by learned counsel for the petitioners that for the petty dispute, the accusation has been levelled. There is a counter version of the occurrence also.

A statement has been made in paragraph -3, that the petitioners have no criminal antecedent.

Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioners. Let the learned Court below consider the prayer for regular bail of the petitioners, if they surrender within a period of six weeks in connection with Mohania P.S. Case No. 70 of 2016, G.R. No. 477 of 2016 pending in the Court of Chief Judicial Magistrate, Kaimur at Bhabhua.
