JUSTICE RAKESH KUMAR ORAL ORDER 15-03-2016 Heard Sri Pranav Kumar, learned counsel for the petitioner and Sri Manoj Kumar no.1, Addl. Public Prosecutor. The present petition was filed under Section 482 of the Code of Criminal Procedure with a prayer to quash an order dated 05.07.2012 passed by the learned Chief Judicial Magistrate, Kishanganj in Kishanganj P.S. Case no.304 of 2008. By the said order, the learned Magistrate had taken cognizance of offence under Section 420 , 409/34 of the Indian Penal Code. In this case, by filing an Interlocutory Application i.e. I.A. No.538 of 2016, it has been prayed to allow the petitioner to amend the prayer. It has been indicated that during pendency of this petition, charge has already been framed. Keeping in view the fact that after the order of
Patna High Court Cr.Misc. No.22154 of 2013 (3) dt.15-03-2016 2/2 cognizance, the stage has changed by way of framing of charge and trial has commenced, I do not find any ground to interfere with the matter.
The petition stands dismissed.
