Mr. Arun Kumar For the Respondent/s :

Mr. BINOD KR. YADAV- SC18 ====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-01-2018 Heard learned counsel for the parties.

2. The petitioners have filed the present writ application seeking quashing of an order, dated 13.02.2017, issued by the Health Department, Government of Bihar, whereby a team has been constituted for inspection of all the recognized Nursing

Patna High Court CWJC No.3274 of 2017(2) dt.03-01-2018 2/2 Training Schools/Institutions and the same team has been directed to submit a report by 25th of February, 2017.

3. Learned counsel appearing on behalf of the State of Bihar informs this Court that this application is premature inasmuch as no inspection has in fact been carried out by the Inspecting team so constituted. He has also submitted that so far that team has not caused any inspection.

4. Since no inspection has been down by the team so constituted by the State Government for inspection, in my view, no purpose would be served by entertaining this application since the notification constituting the inspection has not been given effect to.

5. This application stands disposed of.

6. It shall be open for the petitioners to raise the question of law as raised in the present proceeding in any other appropriate proceedings since I have not gone into such questions in the present order.
