The petitioner seeks bail in Amarpur P.S. Case No. 660 of 2018, registered for the offence punishable under Section 420 and other allied sections of the Indian Penal Code. As per the prosecution case, while the informant was returning his village after loading sand, on the way, this petitioner along with co-accused riding on bike stopped him, took chalan of sand and the key of tractor. One of them went away driving his tractor.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. The looted tractor was recovered from a field which is apparent from the seizure-list itself. Petitioner claims clean antecedent and he is in custody since 17.04.2021. Chargesheet has already been

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 660 of 2018.
