The petitioner is in custody in connection with Mehasi P.S. Case No. 23 of 2019 for the offences under Sections 412, 413, 414 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 24.01.2019. He further submits that allegation against this petitioner is that during the search one automatically loaded pistol with four live cartridges was recovered from the possession of the petitioner.

Considering the fact that petitioner has remained in custody for more than four months, the Court is inclined to grant

No.35434 of 2019(2) dt.30-05-2019 2/2 bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Mehasi P.S. Case No. 23 of 2019.
