The petitioner has prayed for bail in a case registered for the offence punishable under sections 379, 461 of the Indian Penal Code.

As per allegation in the FIR, petitioner is a member of a gang, active in stealing and selling of stolen items. From, CCTV footage, it was found that on 11.08.2022 some unknown thieves committed theft in the informant's shop and committed theft of cash, laptop and other items.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to his long criminal antecedents. No one has identified the petitioner in CCTV footage. On the basis of suspicion, he was

Patna High Court CR. MISC. No.37894 of 2023(2) dt.04-07-2023 2/2 apprehended by the police and police took his confessional statement. Save and except his self confessional statement, nothing has come against the petitioner to show his involvement in the present case. More over, he has not been put on TIP as yet. Petitioner is languishing in judicial custody since 17.01.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bagaha, West Champaran in connection with Bagaha (Pathouli) P.S.
