JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-02-2015 Heard learned counsels for the petitioner and the State. The petitioner being the Ex-Panchayat Mukhiya is apprehending arrest in a case registered for the offences punishable under Sections 409 and 420/34 of the Indian Penal Code.
The accusation is of purchase of solar light on higher price than the price fixed by BIADA.
It is submitted by learned counsel for the petitioner that the solar lights were fixed several years ago and the purchase was made from different company after following the due process of advertisement and inviting tender. Moreover, similarly situated accused persons have been granted anticipatory bail by this Court vide Cr. Misc. Nos. 51658 of 2014 and 2235 of 2015. Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.5103 of 2015 (2) dt.06-02-2015 2/2 petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bhojpur, Ara in connection with Piro P.S. Case No. 315 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
