JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 8, 20(A)(1) and 29 of the NDPS Act.

From the premises of the petitioner, three plants of Ganja were recovered.

It is submitted by learned counsel for the petitioner that stray plants were seized and three stay plants cannot come within the purview of cultivation. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of recovery, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six

Patna High Court Cr.Misc. No.11967 of 2016 (2) dt.11-03-2016 2/2 weeks in connection with Hilsa P.S. Case No. 15 of 2016 pending in the court of learned Sessions Judge, Nalanda at Biharsharif. Accordingly, the application is disposed of.
