This is an application for grant of anticipatory bail in Sadar P.S. Case No. 389 of 2013, disclosing offence under Section 304B of the Indian Penal Code.

Petitioner is mother-in-law of the deceased.

Learned counsel for the petitioner has submitted that there is no allegation in the First Information Report of any demand of dowry and, therefore, no offence punishable under Section 304B of the I.P.C can be said to be made out. He has further submitted that even if the allegation made in the F.I.R. is treated to be correct, it was because of some altercation between the petitioner and the deceased that the deceased appears to have committed suicide.

No.34595 of 2019(3) dt.17-08-2019 2/2 In normal circumstance, I would have entertained this application for anticipatory bail but since this application has been filed six years after lodging of the First Information Report, I am not inclined to entertain this application for grant of anticipatory bail.

This application is accordingly dismissed.

The petitioner is directed to surrender before the Court below within four weeks from today and apply for regular bail, if so advised. Any application for regular bail is made before the Court below, it is directed that the same shall be considered and disposed of on the same day.
