Heard both sides.

The petitioner apprehends his arrest in Bhawanipur P.S.Case No.04 of 2015 under sections 363 and 366A of the Indian penal Code.

The informant herself alleged that while she was going to school, the petitioner forcibly got her seated on his motor-cycle but on alarm, the petitioner dropped her and fled away. Learned counsel for the petitioner submits that the story of kidnapping is not believable. The petitioner was without any arms.

It appears from perusal of the record that there is specific allegation against the petitioner that he made an attempt to kidnap a minor girl.

Patna High Court Cr.Misc. No.5075 of 2015 (2) dt.05-02-2015 Considering the facts, I am not inclined to enlarge the petitioner on anticipatory bail, accordingly the same is rejected. The petitioner may surrender in the court below within four weeks from the date of receipt/production of a copy of this order and the court below shall consider his prayer without being prejudiced by this order.
