The petitioner apprehends his arrest in Bakhtiyarpur P.S. Case No. 06 of 2006 registered under Sections 341, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. Triloki Prasad Singh, the informant, alleged that while he along with Pappu Singh and Nagendra Singh was returning home, accused Musafir Rai, Suresh Rai and Rajendra Rai (the petitioner) accosted the informant and the petitioner fired which hit on the armpit of the informant.

Besides the allegation, the prayer for anticipatory bail of the petitioner was rejected in the year 2008 by the learned Sessions Judge but the petitioner did not surrender for more than six years and the petitioner again moved for anticipatory bail in the year 2014.

Patna High Court Cr.Misc. No.5079 of 2015 (2) dt.05-02-2015 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Bakhtiyarpur P.S. Case No. 06 of 2006, corresponding to S. Tr. No. 1562/10. Accordingly, the same is rejected.

The petitioner is directed to surrender in the court below within four weeks from today in connection with the aforesaid case and make prayer for regular bail. The court below shall consider the prayer for regular bail of the petitioner without being prejudiced by the present order.
