This is an application for anticipatory bail for the offence punishable under sections 406, 420, 467, 468, 471 and 120 (B)/34 of the I.P.C and section 7 of the Essential Commodities Act. Allegedly 416 bags measuring 214.50 quintals wheat was seized loaded on the truck and it is alleged that it was for black marketing. Submission is that the wheat which was seized has already been released in favour of the petitioner by the District Magistrate, Supaul. It is not a case that the wheat was supplied by the Government or it was meant for Government supply and as such the petitioner deserves sympathetic consideration to which the learned A.P.P. fairly submits that the wheat has been released in favour of the petitioner.
In the facts and circumstances stated above, the petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on
Patna High Court Cr.Misc. No.29656 of 2014 (2) dt.13-01-2015 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. Birpur in Nirmali P.S. Case No. 32 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
