JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Patori P.S. Case No. 463 of 2015 for the offences instituted under Sections 147, 438, 504 of the IPC and 3(1)(x), 3(1)(V), (XIV) (XV) of the SC/ST (Prevention of Atrocities) Act. The prosecution story, in brief, is that the accused persons for withdrawing the earlier case pressurized the informant to which he was not ready for that and as a result of which they came armed with weapons and set the house and husk on fire and fled away.

Patna High Court Cr.Misc. No.10887 of 2016 (2) dt.25-04-2016 2/2 It has been submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case. From perusal of the FIR, it is evident that the occurrence has taken place at 7.00 P.M. No source of identification has been disclosed by the prosecution. The household articles damaged in course of occurrence have also not been disclosed by the prosecution. As far as the provision of SC/ST Act is concerned, the same is not attracted in the present case.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Patori P.S. Case No. 463/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Samastipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
