ANJANA PRAKASH ORAL JUDGMENT Date: 17-07-2015 The Petitioner seeks revision of the order dated 30.04.2005 by which the Chief Judicial Magistrate, Saran at Chapra has taken cognizance in Maker P.S. Case No. 23 of 2003 (Tr. No. 1984 of 2005, G.R. No. 2241 of 2003) under the provision of Section 498A/34 IPC and Sections 3/4 of Dowry Prohibition Act.
The Petitioner submits that he is the brother-in-law of the daughter of the Informant and resides abroad and comes to his village only occasionally and he had no role in the domestic affairs of the Informant and her husband. Considering such aspects of the matter, the order of cognizance dated 30.04.2005 passed by the Chief Judicial Magistrate, Saran at Chapra in Maker P.S. Case No. 23 of 2003 (Tr. No. 1984 of 2005) is, hereby, set aside so far as the Petitioner is concerned.
The Revision Application stands allowed.
