2. The petitioner seeks regular bail in connection with Alamganj P.S. Case No. 336 of 2023 registered for the offence under Sections 302 and 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, on 18.04.2023 at about 3:20 P.M., Raj Mistry called the informant's husband for carrying cement. After about 15 minutes, one Ajit Kumar informed the informant that two persons had fired four rounds at her husband and fled from the place of occurrence. Upon reaching the place of occurrence, the informant found her husband lying near the boundary wall in an injured condition. He was taken to the hospital, where he was declared dead.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 16.12.2025. It is further submitted that the petitioner is not named in the FIR rather, the name of the petitioner has come in the case on the confessional statement of the co-accused Suraj Kumar.

5. Per contra, learned counsel for the State vehemently opposes the bail application and submits that the allegations against the petitioner are serious and grave in nature. It is contended that there exists prima facie material against the petitioner indicating his involvement in the commission of the offence. It is also submitted that in the trial, all the witnesses have been examined.

6. Considering the nature and the gravity of the offence, the materials available on record and the allegation levelled against the petitioner, this Court is not inclined to grant regular bail to the petitioner.

7. Accordingly, this application for regular bail stands dismissed.
