The petitioners apprehend their arrest in Muzaffarpur Town P.S. Case No. 217 of 2011, registered for the offences punishable under Sections 419, 420, 465, 467, 468, 471 and 120B of the Indian Penal Code.
The complainant alleged that Hari Shankar Prasad Sinha executed a sale deed with regard to a piece of land in favour of his wife petitioner no. 1 and petitioner no. 2 Mukesh Kumar is a witness of the sale deed. It is alleged that aforesaid piece of land fell in the share of his father who happens to be own brother of Hari Shankar Prasad Sinha.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.7099 of 2015 (2) dt.20-02-2015 2/2 dispute appears to be of civil nature.
Considering the facts aforesaid and the fact that the sale deed was executed in favour of petitioner no. 1 and petitioner no. 2 was the witness of the sale deed, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No. 217 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
