Learned Senior counsel appearing on behalf of the respondent nos. 4 and 5 submits that, on account of passage of time, the present matter appears to have become infructuous. He next submits that otherwise also impugned instruction/circular dated 17.01.2005 (Annexure-3) cannot be legally faulted. Learned State counsel supports the contentions of the learned Senior counsel appearing on behalf of the respondent nos. 4 and 5.
