The petitioner has preferred this application for grant of regular bail in a case registered under section 21(b) of the NDPS Act .

As per the prosecution case, 65 gms of heroin was recovered from possession of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession who being a lady has been falsely implicated in the case. She has no criminal antecedent and is in custody since 4.6.2021. It is submitted that that the alleged quantity is much less than the commercial quantity. Heard learned APP for the State.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.47711 of 2021(3) dt.09-03-2022 2/2 taking into consideration the allegations in the FIR of recovery of 65 gms heroine from the petitioner's possession, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.

Liberty is granted to the petitioner to renew her prayer for bail after four months.
