JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

It is alleged that the purchase and sale registered and stock register of the petitioner were not found in order when the fertilizer were kept in a room other than the place shown in the licence.

It is submitted by learned counsel for the petitioner that the petitioner got the licence on 26.07.2014 whereas the raid was lead on 30.09.2014 and the shop of the petitioner was sealed and subsequently the seizure list was prepared on 03.11.2014 and thereafter the FIR was registered. A statement has been made in para 3 of the petition that the petitioner has no criminal

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhepura in connection with Murliganj P.S. Case No. 193 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
