The petitioner is apprehending his arrest in connection with Ballia P.S.Case no.284 of 2018 , registered for offences punishable under Sections 30(a), 32 and 41(i) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of huge quantity of liquor from the Chimney-Bhatta and the name of the petitioner and other co-accused persons have been disclosed by the spy.

Submission of the learned counsel for the petitioner is that except report of the Spy, there is no other materials against the petitioner and though he is accused in one more case but in that case also on the confessional statement of the co-accused he has been made accused and another co-accused has been

Patna High Court CR. MISC. No.35191 of 2019(3) dt.05-09-2019 2/2 granted privilege of anticipatory bail, vide order dated 30.4.2018 passed in Cr. Misc. No1.2841 of 2019 and he is ready to co-operate in the investigation.

Heard learned A.P.P. , who has opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II cum Special Judge Excise Act, Begusarai in connection with Ballia P.S.Case No.284/2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
