JUSTICE SATYAVRAT VERMA ORAL ORDER 23-03-2023 The present contempt application has been taken out of turn based on mentioning made by the learned counsel for the petitioner showing urgency that the petitioner, a terminated employee, whose representation is not being acted upon by the D.G.P., Bihar despite directions of this Court. The court hearing the mentioning of the learned counsel for the petitioner took the case out of turn but when the matter is taken up today, the Court feels perturbed and disturbed that the manner in which it was mislead by the learned counsel for getting the case heard out of turn.

The present contempt application has been filed alleging violation of the order dated 21.09.2012 in C.W.J.C No. 13590 of 2012 wherein this Court had recorded- "upon hearing learned counsel for the parties, the writ petition is disposed of with a direction that petitioner shall make a representation

Patna High Court MJC No.50 of 2021(3) dt.23-03-2023 2/2 before the Director General of Police, Bihar, Patna and the Director General of Police shall personally look into the matter and pass appropriate order in accordance with law." The learned counsel for the petitioner submitted that the Director General of Police, Bihar has not looked into the matter nor has passed any order but then the learned counsel for the State draws the attention of the Court to Annexure-3 to the writ application which is order dated 11.05.2018 in C.W.J.C. No. 9908 of 2014 preferred by the petitioner whereby he has challenged his order of dismissal from service with effect from 06.02.2014. This Court after hearing the learned counsel for the parties had remanded the case of the petitioner back to the authorities by the said order dated 11.05.2018, thus the order dated 21.09.2012 in C.W.J.C. No. 13590/2012, in view of subsequent development was rightly not acted upon. It absolutely does not stand to reason that as to why this mentioning was made on a false pretext.

Accordingly, the present contempt application stands dismissed.
