JUSTICE RAJAN GUPTA) 01-02-2022 The present writ petition has been filed seeking quashing of the order dated 22.09.2020, passed by the Licensing Officer-cumSub-Divisional Officer, Kahalgaon, District-Bhagalpur, whereby and whereunder the PDS license of the shop of the petitioner bearing License No. 91 of 2016, has been cancelled. At the outset, the Ld. counsel for the petitioner seeks liberty on behalf of the petitioner to file appropriate appeal before the appellate authority as per the provision contained in Rule 32(iii) of the Bihar Targeted PDS (Control) Order, 2016, which is not opposed by the learned counsel for the respondent-State.

Patna High Court CWJC No.138 of 2021(5) dt.01-02-2022 2/2 Accordingly, the present writ petition stands disposed off as not pressed, however, with liberty to the petitioner to file appropriate appeal against the impugned order dated 22.09.2020 before the appellate authority and in case such an appeal is filed within a period of four weeks from today, the appellate authority shall examine the same on merits and pass a reasoned and speaking order, in accordance with law, without being impeded by the issue of limitation, within a period of eight weeks, thereafter.
