====================================================== CORAM: HONOURABLE MR. JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 20-04-2016 The application seeks restoration of S.A. No. 297 of 2013 which stood dismissed for non-compliance of the peremptory order dated 5.9.2014.
The counsel for the petitioner with reference to the statements made in the application explains the circumstances under which he could not remove the defects within the time granted by the Court. He, however, undertakes to remove those defects within two weeks if the application is allowed. The application is allowed and the appeal is restored subject to payment of cost in the sum of Rs. 300/- in favour of the Patna High Court Legal Services Committee within two weeks with further condition that the petitioner shall remove the defects pointed out by the office in S.A. No. 297 of 2013 within two weeks from today.
