The petitioner seeks regular bail in connection with Mahua P.S. Case No. 796 of 2022, registered for the offences punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
The allegation against the petitioner is that earlier he sold plot of land to the informant and the same plot of land has been sold later on to co-accused persons.
Learned counsel for the petitioner submits that the informant had not made the consideration amount to the petitioner against the said sale deed. Accordingly, the petitioner executed another sale deed to the co-accused persons. No case is made out against the petitioner. He further submits that the
Patna High Court CR. MISC. No.41045 of 2023(2) dt.14-07-2023 2/2 dispute is of civil nature. Charge-sheet has already been filed and there is no chance of absconding of the petitioner or tampering with the evidence. Petitioner has one criminal antecedent in which he is on bail. Petitioner is in jail custody since 05.04.2023.
Learned APP for the State has opposed the prayer for regular bail of the petitioner.
Considering the facts and circumstances of the case let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 796 of 2022.
