This application for Anticipatory bail has been preferred by the petitioners, apprehending their arrest in connection with Alamganj P. S. Case No. 92 of 2018, registered for offices under Sections 420, 468 and 506/34 of the Indian Penal Code.

As per the allegation in the F.I.R., the interaction between the informant and the accused persons started on the informant helping the accused persons financially, which led to their becoming partners in the business. It is alleged that the accused persons cheated the informant of Rs. 57 Lacs. As per the case of the petitioners, the main allegation is against one Madhukar Singh. So far as the petitioners are concerned, they are the two sons and wife of the said Madhukar Singh and no specific allegation has been levelled against them.

Patna High Court CR. MISC. No.34875 of 2019(2) dt.30-05-2019 2/2 Learned A.P.P. appearing on behalf of the State opposes the prayer for bail submitting that the petitioners have cheated the informant of a sum of Rs. 57 Lacs. Having heard learned counsels for the parties and having gone through the impugned order, it transpires that the differences arose between the parties due to the financial dispute and ultimate lodging the F.I.R. and it is not more than the nature of a business dispute.

In view of the facts and circumstances of the case, the petitioners are directed to be enlarged on bail in the event of their arrest or surrender in the Court below within a period of six weeks from today in connection with Alamganj P.S.Case No. 92 of 2018, on each of them furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City, Patna, subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
