The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code.

Petitioner is a PDS Dealer. Allegation is that by adopting illegal means of selling the food products in black market, the petitioner allegedly acquired disproportionate assets. Submission of the learned counsel for the petitioner is that the case diary would reveal that no evidence has been brought on the record that the immovable property standing in the name of wife of the petitioner were acquired from the illegal income.

Patna High Court Cr.Misc. No.49210 of 2018 (3) dt.25-10-2018 2/2 Rather the petitioner as well as his wife are income tax payee which would be evident from the copy of the income tax return enclosed with the bail petition.

Considering the entire facts of this case above, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Muffasil Police Station Case No. 171 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
